199 Enforcement of conditions imposed by or under byelaws against owner.E+W

Where the council of a county [F1, metropolitan district] or London borough or the Common Council pass plans for a new street subject to conditions imposed or authorised by new street byelaws in force in the area of that authority, then, those conditions may be enforced at any time by the council against the owner for the time being of the land to which the conditions relate.

In this section “owner” in relation to any land means a person, other than a mortgagee not in possession, who is for the time being entitled to dispose of the fee simple in the land, whether in possession or in reversion, and includes also a person holding or entitled to the rents and profits of the land under a lease the unexpired term of which exceeds 3 years.
