288 Power to require gas and water pipes to be moved.E+W

(1)Section 153 of the M1Public Health Act 1875 (power to require gas and water pipes to be moved) applies for the purposes of any provisions of this Act to which this section applies as it applies for the purposes of that Act; but the said section 153 does not apply in any case in which the code in Part II of the M2Public Utilities Street Works Act 1950 (relations between an authority carrying out road alterations and undertakers whose apparatus is affected thereby) has effect.

(2)A local authority shall pay compensation to any person who sustains damage by reason of the execution by them of works under this section.

(3)This section applies to section 294 below and to the other provisions of this Act which are specified in Schedule 22 to this Act.
