46In section 1(3)(i) (election of alternative to executing remedial works in relation to subsidence damage), for the words “highway maintainable or repairable by the inhabitants at large or a highway in Scotland managed and maintained by the Secretary of State or by a regional or islands council” there shall be substituted the words “public road (within the meaning of the Roads (Scotland) Act 1984”.
