10(1)A hereditament is exempt to the extent that it consists of a right of fishing exercisable in a fishery regulated by an order which—
(a)is made under section 28(3) of the M1Salmon and Freshwater Fisheries Act 1975, and
(b)contains such provision as is mentioned in [F1section 142(1)(a) of the Water Resources Act 1991]
(2)A hereditament is exempt to the extent that it consists of a right of fishing exercisable in a fishery—
(a)which is regulated by the council constituted under section 6 of the M2Tweed Fisheries Act 1969, and
(b)as regards which a rate or assessment is levied under section 79 of the M3Tweed Fisheries Act 1857 or section 5 of the M4Tweed Fisheries Amendment Act 1859.
