6E+WIf an undertaker—
(a)executes any works in contravention of paragraph 2, or
(b)fails to furnish a plan and section in accordance with paragraph 3,
he commits an offence and is liable on summary conviction to a fine not exceeding [F1level 5] on the standard scale.
