1B E+W+S Where—

(a) the Secretary of State or the Scottish Ministers suggest to [F2 the Office of Rail and Road] that an access charges review should be carried out in any case, but

(b) that Office decides not to carry out the suggested review,

that Office must provide the Secretary of State or Scottish Ministers with its reasons for that decision.]
