[F1(1)]Subject to section 205 of this Act [F2and subsection (3) below] , where a child is convicted on indictment and the court is of the opinion that no other method of dealing with him is appropriate, it may sentence him to be detained for a period which it shall specify in the sentence; and the child shall during that period be liable to be detained in such place and on such conditions as the Secretary of State may direct.
[F3(1A)Where the court imposes a sentence of detention on a child, the court must—
(a)state its reasons for the opinion that no other method of dealing with the child is appropriate, and
(b)have those reasons entered in the record of the proceedings.]
[F4(2)[F5Subsections (1) and (1A) above are] subject to—
(a)section 51A(2) of the Firearms Act 1968 (minimum sentences for certain firearms offences); and
(b)section 29(9) of the Violent Crime Reduction Act 2006 (minimum sentence of detention for certain offences relating to dangerous weapons).]
[F6(3)If the child is under the age of 16 years, the power conferred by subsection (1) above shall not be exercisable in respect of a conviction for an offence under section 9(1) of the Antisocial Behaviour etc. (Scotland) Act 2004 (asp 8) or that section as applied by section 234AA(11) of this Act.]
