28In section 23 of the [1988 c. 33.] Criminal Justice Act 1988 (first-hand hearsay) the following subsection shall be inserted after subsection (4)—
“(5)This section shall not apply to proceedings before a magistrates' court inquiring into an offence as examining justices.”
