9(1)All fees and other sums received by the Commissioner in the exercise of his functions under this Act [F1, under section 159 of the Consumer Credit Act 1974 or under the Freedom of Information Act 2000] shall be paid by him to the [F2 Secretary of State] .U.K.
(2)Sub-paragraph (1) shall not apply where the [F2 Secretary of State] , with the consent of the Treasury, otherwise directs.
(3)Any sums received by the [F2 Secretary of State] under sub-paragraph (1) shall be paid into the Consolidated Fund.
