(1)If the Commission is satisfied that a licence holder—

(a)is contravening [F1any relevant requirement], or

(b)is likely to contravene any such [F2requirement],

the Commission shall by order make such provision as is needed for the purpose of securing compliance with [F3the requirement].

(2)An order under subsection (1)—

(a)shall require the licence holder to do, or not to do, such things as are specified in the order or are of a description so specified,

(b)shall take effect at such time, being the earliest practicable time, as is determined by or under the order, and

(c)may be revoked at any time by the Commission.

(3)An order under subsection (1) shall have effect until such time (if any) as the Commission revokes it.

(4)This section is subject to section 25.

[F4(5)In this Act—

  • “final order” means an order under this section;

  • “relevant requirement”, in relation to a licence holder, means—

    (a)

    a condition of the licence holder’s licence, or

    (aa)

    [F5an obligation imposed under section 61A, or]

    (c)

    an obligation imposed on the licence holder by virtue of section 25(5) of the Consumers, Estate Agents and Redress Act 2007 (directions to comply with requirements to provide information under section 24 of that Act)][F6, or

    (d)

    an obligation imposed under section 43, 46 or 47 of that Act (complaints).]
