83 Meaning of “Welsh public authority”. U.K.

(1) In this Act “Welsh public authority” means—

(a) any public authority which is listed in Part II, III, IV or VI of Schedule 1 and whose functions are exercisable only or mainly in or as regards Wales, other than an excluded authority, or

[F1 (b) any public authority which is—

(i) a subsidiary of the Welsh Ministers (as defined by section 134(4) of the Government of Wales Act 2006), or

(ii) a subsidiary of the Assembly Commission (as defined by section 139(4) of that Act).]

(2) In paragraph (a) of subsection (1) “excluded authority” means a public authority which is designated by the [F2 Secretary of State] [F3 or the [F4 Minister for the Cabinet Office]] by order as an excluded authority for the purposes of that paragraph.

(3) Before making an order under subsection (2), the [F2 Secretary of State] [F5 or the [F6 Minister for the Cabinet Office]] shall consult [F7 the First Minister for Wales].
