The Merseyside Passenger Transport Area (Adaptation of Enactments and Instruments) Order 1973

Interpretation

2.—(1) In this Order, unless the context otherwise requires—

“the Act of 1968” means the Transport Act 1968;

“the Act of 1972” means the Local Government Act 1972;

“additional undertaking” means a road passenger transport undertaking specified in column (2) of Schedule 1 to this Order (being an undertaking to be transferred to the Executive on 1st April 1974 by order under section 254 of the Act of 1972) and, when used in relation to an operating authority, means the undertaking described in column (2) of that Schedule opposite to the name of that authority in column (1) of that Schedule;

“the Designation Order” means the Merseyside Passengers Transport Area (Designation) Order 1969(1):

“the Executive” means the Merseyside Passenger Transport Executive;

“operating authority” means an existing local authority specified in column (1) of Schedule 1 to this Order and, when used in relation to an additional undertaking, means the existing local authority whose name in that column is opposite to the description of that undertaking in column (2) of that Schedule.

“public service vehicle” has the same meaning as in the Road Traffic Act 1960;

“the Railway Passenger Services Order” means the Merseyside Passenger Transport Area (Railway Passenger Services) Order 1971;

“statutory provision” means a provision contained in, or in an instrument made under, an Act;

“successor authority” in relation to an additional undertaking, means the council of the new district which comprises the whole or the major part of the area within which, immediately before 1st April 1974, the additional undertaking was being carried on;

“the Transfer Order” means the Merseyside Passenger Transport Area (Transfer of Undertakings) Order 1969.

(2) Except where the context otherwise requires, any reference in this Order to any enactment shall be construed as a reference to that enactment as amended, extended or applied by or under any other enactment.

(3) The Interpretation Act 1889 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.
