The Pensions Increase (Judicial Pensions) Regulations 1974

EXPLANATORY NOTE

These Regulations apply the Pensions (Increase) Act 1974 to the judicial and other pensions described in the Schedule.

The Regulations:—

(1)

specify, in paragraphs 2-6 and 8-11 of the Schedule, those classes of pensions based on a salary an increase of which was deferred during the period 6th November 1972 to 31st March 1973; pensions of these classes which begin after 1st January 1973 will consequently be increased in accordance with Part I of the Schedule to the 1974 Act. The pensions specified in paragraphs 1 and 7 of the Schedule to the Regulations will be increased in accordance with Part II of the Schedule to the 1974 Act;

(2)

specify the “relevant date”—the date of the principal pay increase made or expected to be made during the year ending 6th November 1974—for the pensions to which the Regulations apply;

(3)

modify the provisions of the 1974 Act in relation to these pensions so that no increase is payable on pensions which begin after the specified relevant date. The modification is required because the pensions are calculated by reference to the annual rate of salary in force on the last day of service rather than on the salary paid over a period of 12 months.

Under the powers in section 4(3) of the 1974 Act the Regulations provide for increases payable by virtue of the Regulations to take effect from 1st December 1973.
