The Health and Social Security Act 1984 (Commencement No.1) Amendment Order 1984

In exercise of the powers conferred upon me by section 27(1) of, and paragraph 16 of Schedule 4 to, the Health and Social Security Act 1984 and of all other powers enabling me in that behalf, I hereby make the following order:—

Citation

1.  This order may be cited as the Health and Social Security Act 1984 (Commencement No.1) Amendment Order 1984.

Amendment of the Health and Social Security Act 1984 (Commencement No.1) Order 1984

2.  In the Health and Social Security Act 1984 (Commencement No.1) Order 1984, Article 3(4) (days appointed for the coming into force of section 11 of, and Schedule 4 to, the Health and Social Security Act 1984) shall be amended by substituting for head (iii) of sub-paragraph (a) the following head:—

   

(iii)any person who is incapable of work on or after 29th November 1984 on a day within the same period of interruption of employment as a day on which he was entitled to a non-contributory invalidity pension; and in determining for the purposes of this paragraph whether a day falls within a period of interruption of employment, the provisions of section 17(1) of the Social Security Act 1975(1) (days for which unemployment, sickness and invalidity benefit are payable) and of any regulations made under section 17(1) and (2) of that Act shall have effect;.

EXPLANATORY NOTE

This Order amends Article 3(4)(a)(iii) of the Health and Social Security Act 1984 (Commencement No.1) Order 1984 and provides that 29th November 1984 is the day appointed for the coming into force of section 11 of and Schedule 4 to that Act (severe disablement allowance) in the case of a person aged over 35 but under 50 who is incapable of work on any day on or after 29th November 1984 where that day and an earlier day upon which he was entitled to a non-contributory invalidity pension fall within the same period of interruption of employment.
