8.   A deduction made in accordance with this Schedule is a deduction by way of recovery for the purposes of regulation 40(3) of the Income Support (General) Regulations 1987[F2 , regulation 104(3)of the Employment and Support Allowance Regulations] and regulation 103(3) of the Jobseeker’s Allowance Regulations 1996.]
