The Secretary of State for Social Services, in exercise of the powers conferred upon him by section 128 of, and Schedule 20 to, the Social Security Act 1975(1) and section 123 of, and Schedule 17 to, the Social Security (Northern Ireland) Act 1975(2) and of all other powers enabling him in that behalf, after agreement by the Social Security Advisory Committee that proposals to make these Regulations should not be referred to it(3), hereby makes the following Regulations:—

Citation and commencement

1.  These Regulations may be cited as the Social Security (Benefit) (Members of the Forces) Amendment Regulations 1988 and shall come into force on 11th April 1988.

Amendment of regulation 3 of the Social Security (Benefit) (Members of the Forces) Regulations 1975

2.  In regulation 3(1) of the Social Security (Benefit) (Members of the Forces) Regulations 1975(4), for the words“the period of 6 weeks next after such discharge, cashiering or dismissal” there shall be substituted the words“such period not exceeding 26 weeks as may be determined in accordance with sections 97 to 104 of the Act or, as the case may be, sections 97 to 104 of the Northern Ireland Act (adjudication by adjudication officers and other statutory authorities).”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Social Security (Benefit) (Members of the Forces) Regulations 1975 so as to provide for the period of disqualification for receiving unemployment benefit to be extended from one of 6 weeks to one of up to 26 weeks in the case of a serving member of the armed forces who is discharged, cashiered or otherwise dismissed from the force.
