The Lord Chancellor, in exercise of the powers conferred on him by sections 20 and 25 of the Legal Aid Act 1974(1), and with the concurrence of the Treasury, hereby makes the following Regulations:—
1. These Regulations may be cited as the Legal Advice and Representation (Duty Solicitor) (Remuneration) (Amendment) Regulations 1988 and shall come into force on 1st April 1988.
2. The Legal Advice and Representation (Duty Solicitor) (Remuneration) Regulations 1987(2) shall be amended as follows—
(1) for the definition “the 1982 Regulations” in regulation 2, there shall be substituted the following definition—
““the 1988 Regulations ”means the Legal Aid in Criminal Proceedings (Costs) Regulations 1988;”(3);
(2) for the words “paragraph 1(a) of Schedule 1 to the 1982 Regulations” in regulation 6(2)(a) and (b), there shall be substituted the words “paragraph 1(1)(a) of Schedule 1 Part I to the 1988 Regulations”; and
(3) for the words “the 1982 Regulations” and “standard rates” in regulation 6(2), there shall be substituted the words “the 1988 Regulations” and “basic rates” respectively.

These Regulations amend the Legal Advice and Representation (Duty Solicitor) (Remuneration) Regulations 1987 in consequence of the revocation of the Legal Aid in Criminal Proceedings (Costs) Regulations 1982 (S.I. 1982/1197) by the Legal Aid in Criminal Proceedings (Costs) Regulations 1988.
1974 c. 4; section 20 was amended by the Legal Aid Act 1979 (c. 26), section 4(2), by the Civil Jurisdiction and Judgments Act 1982 (c. 27), section 40(1) and by the Legal Aid Act 1982 (c. 44), sections 1, 16; section 25 is an interpretation provision and is cited because of the meaning assigned to the word “regulations”.
