The Secretary of State for Transport, in exercise of the powers conferred by sections 45 and 46 of the Road Traffic Act 1988(1) and by the Department of Transport (Fees) Order 1988(2), and of all other enabling powers, and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:—

1.  These Regulations may be cited as the Motor Vehicles (Tests) (Amendment) (No. 2) Regulations 1990 and shall come into force on 2nd April 1990.

2.  The Motor Vehicles (Tests) Regulations 1981(3) shall be further amended in accordance with the provisions of these Regulations.

3.  In regulation 20(4) in the Table for “£17.75” there shall be substituted “£18.75”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Motor Vehicles (Tests) Regulations 1981 as amended by the Motor Vehicles (Tests) (Amendment) Regulations 1990 (“the 1990 Regulations”), S.I. 1990/449

They correct an error in the 1990 Regulations. In those Regulations it was intended to increase the fee payable for the re-examination of a vehicle constructed or adapted to carry more than 12 passengers, within 14 days of the date of the issue of the notice of refusal of a test certificate, from £17.75 to £18.75. The 1990 Regulations however referred to the sum of £17.75. These Regulations increase the fee as intended.
