Explanatory Note

This note is not part of the Regulations)

These Regulations, which come into force on 1st September 1992, supersede the Education (Mandatory Awards) Regulations 1991 (as amended by the Education (Mandatory Awards) (Amendment) Regulations 1992) which are revoked (regulation 6(1)).

Provisions in these Regulations which differ from the corresponding provisions of the 1991 Regulations (except as a result of minor drafting or consequential changes) are indicated by the use of heavy type.

Omissions are indicated by the use of dots.

The changes of substance made by these Regulations other than the changes in the rates of grant and allowances are described below.

Provision has been made to prevent students who had received a mandatory award to attend a course leading to the Diploma in Higher Education or the Higher National Diploma from receiving a second award to attend a second, similar course.

Provision has also been made to prevent students who had received a mandatory award to attend a first degree course of two years' duration from receiving a second award to attend a further first degree course of any duration.

Transitional provisions have been made in both cases to allow second awards already bestowed to continue to be paid (regulation 12).

Provision has been made to allow an award to be bestowed on a student who transfers from a designated course for which he held a Department of Health bursary to another designated course to which his bursary cannot be transferred (regulation 12). Students on designated courses who are receiving payments under the Higher Technology National Training Scheme will no longer be eligible to receive payments under the Regulations (regulation 23).

The time limits for the payment of fees have been amended (regulation 24).

The provision on the payment of tuition fees for sandwich courses has been amended so that, in a year in which there are periods of experience and short periods of full-time study occur (of no more than ten weeks' study in total), a half-fee is payable instead of a full one (Schedule 1).

The rules for deciding upon a parental contribution have been amended so that, where a student with separated parents lives with one parent but the parental contribution is assessed on the other parent and that other parent dies, the contribution is no longer assessed instead on the surviving parent (Schedule 3).

The separate rules for assessing the parental contribution for students whose courses started before 15th March 1988 have been removed (Schedule 3).
