The Orkney Islands Area (Electoral Arrangements) Order 1992

13th December 1992

Coming into force in accordance with Article 1(2)

Whereas under section 17(1) of the Local Government (Scotland) Act 1973(1) the Local Government Boundary Commission for Scotland on 19 March 1992 submitted to the Secretary of State a report on a review together with their proposals for a change of the electoral arrangements for the Orkney Islands Area;

Now, therefore, in exercise of the powers conferred on him by sections 17(2) and 233 of the said Act and of all other powers enabling him in that behalf, the Secretary of State hereby makes the following Order:

Citation and commencement

1.—(1) This Order may be cited as the Orkney Islands Area (Electoral Arrangements) Order 1992.

(2) This Order shall come into force on 5th May 1994 provided that for the purpose of all proceedings preliminary or relating to an election to be held on or after that day the Order shall come into force on 10th October 1993.

Interpretation

2.  In the Schedule to this Order—

(a)a reference to—

(i)an electoral division shall be construed as a reference to that electoral division as constituted in this Order;

(ii)a road, footpath, railway line, river, burn or canal shall, where the context so admits, be construed as the centre line of the feature concerned; and

(iii)the boundary or boundaries of a parish is to a line corresponding as nearly as may be to the line of the boundary or boundaries of the parish concerned as already published on Ordnance Survey Maps;

(b)the expedient of defining a line beyond Mean Low Water Springs has been adopted to apportion islands to the appropriate electoral division; and

(c)the following abbreviations are used:

Change of electoral arrangements

3.  The existing electoral divisions of the Orkney Islands Area shall be abolished and the said Area shall be divided into twenty-eight electoral divisions having the names, contents and boundaries set forth in the Schedule to this Order.

4.  The boundaries of the electoral divisions constituted by this Order shall be defined and mered by Ordnance Survey.

Revocation

5.  Without prejudice to its continuing in effect for the purposes of defining the electoral divisions prior to the coming into force of this Order, the Orkney Islands Area (Electoral Arrangements) Order 1977(2) is hereby revoked. SCHEDULEDESCRIPTIONS OF BOUNDARIES OF ELECTORAL DIVISIONS FOR ORKNEY ISLANDS AREA

Electoral Division 1: Kirkwall Pickaquoy

Commencing in the Bay of Kirkwall at the MLWS at West Pier at a point in line with Junction Road; then southward in a straight line to and along Junction Road to Mounthoolie Place; then eastward along Mounthoolie Place and Mounthoolie Lane to Albert Street; then generally southward along Albert Street, Broad Street, Victoria Street and Main Street to Junction Road; then southwestward across Junction Road and along Wellington Street and High Street to Glaitness Road; then westward along Glaitness Road to the western curtilage of Langskail then southward along said curtilage and field boundary to Corse Loan; then westward along Corse Loan to and along field boundaries lying to the north of Colwin to meet the track lying to the east of Walliwall Quarry at grid reference HY 4335 1030: then northward along said track to meet Old Finstown Road; then westward along Old Finstown Road to Sunnybank Road then northward along said road to its junction with the access road to the water reservoir at grid reference HY 4295 1185; and then northwestward along field boundary to the Hatston Burn at grid reference HY 4279 1219; and then generally north eastward following the Hatston Burn to the MLWS in the Bay of Kirkwall at grid reference HY 4350 1300; then generally eastward and southward along MLWS to point of commencement.

Electoral Division 2: Kirkwall Craigiefield

Commencing at MLWS in the Bay of Kirkwall east of the pier at a point in line with St Catherine’s Place; then southward in a straight line to and along St Catherine’s Place to East Road; then eastward along East Road and Easthill to the field boundary at grid reference HY 4595 1125 at the eastern boundary of Weyland Farm; then southeastward and northeastward along field boundaries to grid reference HY 4615 1115; then southeastward along the field boundaries and the rear curtilage of Viewfield to grid reference HY 4640 1075; then eastward in a straight line to the MLWS in the Bay of Berstane; then generally northward, westward and southward along the MLWS to the point of commencement.

Electoral Division 3: Kirkwall Broadsands

Commencing at the junction of Clay Loan and Main Street on the eastern boundary of ED 1; then generally westward and southward following the boundary of said ED to Corse Loan; then eastward along Corse Loan to the rear curtilage of the houses lying to the west of Old Scapa Road; then southward along the rear curtilage of said houses to the southern curtilage of Brinyan then eastward along said curtilage to Old Scapa Road; then southward along Old Scapa Road to its junction with the access to Crantit Cottages; then eastward along said access road and its continuation thereof to the A963; then northward along the A963 to its junction with Pipersquoy Road; then eastward along Pipersquoy Road to its junction with Pipersquoy Drive; then northward along Pipersquoy Drive to Quoybanks Drive; then eastward along Quoybanks Drive to Earl Thorfinn Street; then northward along Earl Thorfinn Street to Clay Loan; then westward along Clay Loan to the point of commencement.

Electoral Division 4: Kirkwall Lynnfield

Commencing on the field boundary on the eastern boundary of ED 3 at grid reference HY 4485 0975 on the A963; then southeastward along said field boundary to the western curtilage of the Highland Park Bond Store; then southward and southeastward along the said curtilage to meet the A961; then southward along the A961 to the track adjoining the southwestern curtilage of Highland Park Distillery; then southeastward along said track to grid reference HY 4525 0915; then northeastward along said track to the western curtilage of the houses at Lynnside; then southeastward and northeastward and again southeastward and northeastward along said curtilage to the A960; then southeastward along the A960 to meet the western boundary of the parish of St Andrews and Deerness; then northeastward along said parish boundary to the MLWS in Inganess Bay east of the Point of Grimsetter; then westward and northward along MLWS to the point known as Brough grid reference HY 4741 0965; then westward in a straight line to field boundary at grid reference HY 4685 0970; then northwestward along the field boundary and track to Berstane Loan to the north of Graenngarth; then northeastward along Berstane Loan to the field boundary at grid reference HY 4630 1010; then northwestward along said field boundary to the southeastern curtilage of the houses at Papdale East; then southwestward and northwestward along said curtilage to The Meadows; then southeastward along The Meadows to Bignold Park Road; then northwestward along Bignold Park Road to its junction with Holm Road; then southward along Holm Road to the southern curtilage of Ardcoille; then generally northwestward along the said curtilage and the rear curtilages of the houses in Quoybanks Crescent and Kirklands Road to and along the western curtilage of 17 Pipersquoy Road to Pipersquoy Road; then westward and southward along the boundary of ED 3 to the point of commencement.

Electoral Division 5: Kirkwall Quoybanks

Commencing at junction of Earl Sigurd Street and Earl Thorfinn Street on the eastern boundary of ED 3; then southward, westward and again southward, eastward and northward along the eastern and northern boundaries of EDs 3 and 4 to the junction of Holm Road and Bignold Park Road; then northward along Bignold Park Road to the northern curtilage of Failte; then westward and southward along the western curtilage of Failte, Hampton, Fairmount and Lambsholm to the southern curtilage of 12 King Haakon Street; then westward along said curtilage and Earl Sigurd Street to the point of commencement.

Electoral Division 6: Kirkwall Papdale East

Commencing on the northern boundary of ED 4 on the southeastern curtilage of the houses at Papdale East at grid reference HY 4602 1041; then southwestward and northwestward along the northern boundary of ED 4 to The Meadows; then northeastward along The Meadows to a point in line with the northern gable of Craigerne; then eastward in a straight line to the western curtilage of Craigerne; then southeastward along the western curtilage of the houses in Berstane Road to the northwest curtilage of Endorholm; then southwestward along the field boundary to the point of commencement.

Electoral Division 7: Kirkwall Bignold

Commencing at the junction of Clay Loan and Earl Thorfinn Street on the eastern boundary of ED 3; then southward along the boundary of said ED and eastward, northward and southward along the northern boundary of ED 5 to the junction of Holm Road and Bignold Park Road; then southward along the boundary of ED 4 to The Meadows; then northward along The Meadows to the rear curtilage of the houses on the southwest side of Papdale Road; then northward along said curtilage to the northwestern boundary of Kirkwall Grammar School; then southwestward and northwestward along said boundary to Willow Road; then northwestward along Willow Road to The Keelies; then southwestward along The Keelies to Thoms Street; then westward along Thoms Street to Dundas Crescent; then southward along Dundas Crescent to Clay Loan; then westward along Clay Loan to the point of commencement.

Electoral Division 8: Kirkwall Berstane

Commencing at MLWS in Inganess Bay on the northern boundary of ED 4; then westward and northwestward along said ED boundary, northeastward, northwestward and southwestward along the boundary of ED 6 and northwestward, southwestward and again northwestward along the boundary of ED 7 to the junction of Willow Road and Willowburn Road; then generally northwestward along Willowburn Road to Queen Street; then northeastward along Queen Street and East Road to the southern boundary of ED 2 at St Catherine’s Place; then eastward and southeastward along the southern boundary of said ED to the MLWS in the Bay of Berstane; then southward along the MLWS to the point of commencement.

Electoral Division 9: Kirkwall St Magnus

Commencing at the MLWS in the Bay of Kirkwall at the West Pier on the eastern boundary of ED 1; then generally southward along said ED boundary to northern boundary of ED 3 then eastward along boundary of ED 3 and ED 7 and generally northward along the boundaries of ED 7, ED 8 and ED 2 to the MLWS in the Bay of Kirkwall on the western boundary of ED 2; then westward along the MLWS to the point of commencement.

Electoral Division 10: Stromness South

Commencing at MLWS west of Staigs of Nethertown in Hoy Sound at a point in line with Nethertown Road; then northward in a straight line to and generally northeastward along Nethertown Road to the unclassified road leading northwest from the Rocket House to Brownstown; then northwestward along the said road to and southeastward along Outertown Road to Franklin Road; then generally eastward, northward and southeastward along Franklin Road to and continuing southeastward along Graham Place and its prolongation between Nos 16 and 20 Graham Place to MLWS; then generally southward and westward along MLWS to the point of commencement.

Electoral Division 11: Stromness Central

Commencing at the junction of the western and northern boundaries of ED 10 on Outertown Road; then northwestward along the unclassified road leading past Brownstown to the field boundary in line with the northwestern boundary of Marwick Playing Field; then northeastward along the said boundaries to the track forming the continuation of Grieveship Road; then northwestward along the said track to and northeastward along the path passing over the summit of Brinkies Brae to the path leading southeastward from grid reference HY 2530 0985; then southeastward along the said path to and southward along the track leading south toward Ocean View to the line of field boundaries leading to the southern curtilage of No 21 North End Road; then eastward along the said field boundaries to and northward and eastward along the western and northern curtilages of No 21 North End Road to North End Road; then northward along the said road to the western end of Cairston Road; then south-southeastward in a straight line to and generally southward along MLWS to the northern boundary of ED 10; then generally northwestward along the said ED boundary to the point of commencement.

Electoral Division 12: Stromness North

Commencing at MLWS in Hoy Sound at the western boundary of ED 10; then generally northwestward and northward along MLWS to the northern boundary of Stromness parish; then generally eastward and southward along the said parish boundary to Bridge of Waithe; then southwestward in a straight line to and continuing generally southwestward along MLWS to the northern boundary of ED 11; then generally westward and southwestward along the northern and western boundaries of ED 11 and the western boundary of ED 10 to the point of commencement.

Note: ED 12 contains all the islands in the parish of Stromness.

Electoral Division 13: Orphir and Scapa

Commencing at the MLWS in Scapa Bay south of Harbour House in line with the A963 road; then northward along the A963 to the southern boundary of ED 3; then westward, northward, westward and again northward along the southern boundary of ED 3 and ED 1 to the junction of Sunnybank Road and the access road to Sunnybrae Farm at grid reference HY 4285 1110; then northwestward along the said access road and the continuation thereof in a straight line to Wideford Hill; then southwestward in a straight line to meet the Firth/St Ola parish boundary west of Smerquoy on Old Finstown Road then generally southward and westward following the parish boundary of Firth to the Hill of Lyradale; then following the Orphir parish boundary to the MLWS at Moo Taing; then generally southward and eastward along the MLWS to the point of commencement.

Electoral Division 14: Firth and Sunnybrae

Commencing at the MLWS in the Bay of Kirkwall on the western boundary of ED 1; then southward and westward along the western and northern boundaries of ED 1 and ED 13 to the Hill of Lyradale; then westward, northward and eastward following the Firth Parish boundary to the MLWS at the Bay of Isbister; then generally southward and eastward along the MLWS to the point of commencement. Note: ED 14 contains all the islands in the parish of Firth.

Electoral Division 15: Harray and Stenness

Commencing at MLWS at Moo Taing in Hoy Sound on the western boundary of the parish of Stenness; then northward along said parish boundary to its junction with eastern boundary of Sandwick parish; then northeastward and northward along said parish boundary to a point due south of the end of the pier adjoining the hotel at Grut Ness; then due north in a straight line to the pier and the northwestern boundary of the hotel; then generally northeastward following the boundaries of the hotel and of the Cottage to Russland Road; then northeastward along Russland Road to and northwestward along the A986 road to the southern curtilage of Brekka; then northeastward and northwestward following the boundaries of the said property and the rear curtilages of properties on the east side of the A986 road to rejoin the eastern boundary of Sandwick parish; then northwestward along the said parish boundary to and northeastward along Hillside Road to the eastern curtilage of Hosen; then southward along the said curtilage to the track leading southward to Newhouse; then due east in a straight line to the eastern boundary of the parish of Birsay and Harray northwest of Mid Tooin; then generally southeastward along the said parish boundary to the eastern boundary of the parish of Stenness; then generally southward and eastward along the said parish boundary to the point of commencement.

Electoral Division 16: Evie and Rendall

Contains the parish of Evie and Rendall.

Electoral Division 17: Birsay

Commencing at MLWS on the west coast of the Mainland at the northern boundary of ED 18; then generally northward and eastward along MLWS to and generally southeastward along the eastern boundary of the parish of Birsay and Harray to the northern boundary of ED 15; then generally westward along the northern boundaries of EDs 15 and 18 to the point of commencement.

Electoral Division 18: Sandwick

Commencing at MLWS on the west coast of the Mainland at the northern boundary of ED 12; then generally northward along MLWS to and generally eastward along the northern boundary of Sandwick parish to the western boundary of ED 15; then generally southward and westward along the western boundary of ED 15 to its junction with the northern boundary of ED 12; then following the northern boundary of ED 12 to the point of commencement.

Electoral Division 19: St Andrews and Deerness

Contains the parish of St Andrews and Deerness.

Electoral Division 20: Holm and Wideford

Commencing at the MLWS in Scapa Bay on the eastern boundary of ED 13; then generally northward, eastward and southeastward along the eastern boundaries of EDs 13 and 3 and the southern boundary of ED 4 to the boundary of the parish of St Andrews and Deerness; then westward along the said parish boundary to the boundary of the parish of Holm; then generally southeastward along the said parish boundary to the MLWS at Camy; then southward, westward and northward along MLWS to the point of commencement. Note: ED 20 contains the island of Lamb Holm.

Electoral Division 21: Burray and South Ronaldsay

Consists of the parish of South Ronaldsay excluding that part of the island of South Ronaldsay lying north and west of the following line:Commencing at the MLWS in Sandwick Bay at the mouth of the Sandwick Burn; then northeastward along said Burn to the A961; then northwestward and northeastward along said road to its junction with the unclassified road to Herston at Eastdam; then northeastward in a straight line to Vensilly Hill; then northeastward in a straight line to the water storage tank at grid reference ND 4675 9231; then northward in a straight line passing to the east of the former meal mill at Cara to the MLWS at grid reference ND 4675 9464 in Water Sound.

Electoral Division 22: St Margaret’s Hope

Consists of that part of the island of South Ronaldsay lying north and west of the line described in ED 21.

Electoral Division 23: Hoy and Graemsay and Walls and Flotta

Contains the parishes of Hoy and Graemsay, and Walls and Flotta.

Electoral Division 24: Rousay, Egilsay and Wyre

Contains the parish of Rousay.

Electoral Division 25: Shapinsay

Contains the parish of Shapinsay.

Electoral Division 26: Stronsay and Eday

Contains the parishes of Stronsay and Eday.

Electoral Division 27: Sanday and North Ronaldsay

Contains the parishes of Cross and Burness, and Lady.

Electoral Division 28: Westray and Papa Westray

Contains the parishes of Westray and Papa Westray.

Explanatory Note

(This note is not part of the Order)

This Order gives effect to proposals made by the Local Government Boundary Commission for Scotland for a change to electoral arrangements for the Orkney Islands Area (the Area) as described in the Schedule to the Orkney Islands Area (Electoral Arrangements) Order 1977 (the 1977 Order).

The effect of the proposals is to divide the Area into 28 electoral divisions as described in the Schedule to the Order.

The 1977 Order is revoked by this Order.
