The Secretary of State, in exercise of the powers conferred on him by section 13(4)(g) and 190(1) of the Local Government and Housing Act 1989(1), and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Local Government (Committees) (Amendment) Regulations 1993 and shall come into force on 23rd June 1993.

Functions in the discharge of which all members of committees may have voting rights

2.—(1) The Local Government (Committees and Political Groups) Regulations 1990(2) shall be amended as follows.

(2) In regulation 4(1)(h), for the words from “the Local Authority Social Services Act 1970” to “the Superannuation Act 1972” there shall be substituted “any provision mentioned in the Schedule to these Regulations”.

(3) There shall be inserted at the end the Schedule contained in Schedule 1 to these Regulations.

Sussex Downs Conservation Board

3.  The functions of the East Sussex County Council and the West Sussex County Council specified in Schedule 2 to these Regulations are prescribed for the purposes of section 13(4)(g) of the Local Government and Housing Act 1989 in so far as they have been delegated to the joint committee established by those councils on 1st April 1992 in relation to the Sussex Downs Area of Outstanding Natural Beauty.

Revocation

4.  Article 3 of the Local Government (Committees and Political Groups) (Amendment) Regulations 1991(3) is revoked.

Explanatory Note

(This note is not part of the Regulations)

These Regulations, which extend to England and Wales, amend the Local Government (Committees and Political Groups) Regulations 1990 in respect of the circumstances in which the members of certain committees of local authorities may have voting rights.

Regulation 2 adds certain functions connected with highways and with the countryside to the functions in respect of the discharge of which all members of a committee may have voting rights. All such functions are consolidated in Schedule 1. Regulation 4 effects a consequential revocation.

Regulation 3 enables all the members of the Sussex Downs Conservation Board to vote in respect of the matters delegated to that body (which are specified in Schedule 2) by the councils of the counties of East Sussex and West Sussex.
