The Secretary of State for Transport makes this Instrument in exercise of his powers conferred by Section 106(3) of the Highways Act 1980(1), and now vested in him(2), and of all other powers enabling him in that behalf:

1.  The Cheshire County Council (Trent and Mersey Canal Bridge Wheelock) Scheme 1993 (hereinafter referred to as “the Scheme”) is hereby confirmed.

2.  The Scheme as confirmed is set out in the Schedule hereto and copies of the Scheme with its accompanying plans are deposited at the offices of the Department of Transport, 43 Marsham Street, London SW1P 3PY and the offices of Cheshire County Council, Legal and Members Services, County Hall, Chester CH1 1SF.

3.  The Scheme will become operative on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

4.  This Instrument may be cited as The Cheshire County Council (Trent and Mersey Canal Bridge, Wheelock) Scheme 1993 Confirmation Instrument 1994.

THE SCHEDULETHE CHESHIRE COUNTY COUNCIL (TRENT AND MERSEY CANAL BRIDGE, WHEELOCK) SCHEME 1993

The Cheshire County Council (hereinafter referred to as “the Council”) makes this Scheme in exercise of their powers under Section 106(3) of the Highways Act 1980 and of all other enabling powers:

1.  The Council are authorised to construct over the navigable waters of the Trent and Mersey Canal the bridge specified in the Schedule to this Scheme as part of the highway which they are proposing to construct between the A534 Haslington Bypass and the A534 Sandbach Inner Relief Road, in the Borough of Congleton in the County of Cheshire.

2.  This Scheme may be cited as the Cheshire County Council (Trent and Mersey Canal Bridge, Wheelock) Scheme 1993.

Points of Commencement and Termination

From a point on the south bank of the Trent and Mersey Canal approximately 40 metres south of Cotton Lane and the crossing point of the new highway over the canal.

To a point on the north bank of the Trent and Mersey Canal approximately 20 metres north of the River Wheelock and the crossing point of the new highway over the canal.

Spans

Multi-span with main spans of 25 metres (3) and 20 metres.

Headway

Approximately 4.4 metres above canal water level.

Waterway

A minimum clear navigable waterway of 9 metres (unaffected by new bridge).

Over Dimensions

124 metres overall, spanning over Cotton Lane, Trent and Mersey Canal and the River Wheelock (non-navigable waterway).

The Bridge will be 11.3 metres wide overall and will carry a 9.3 metre wide single carriageway, with a 1 metre wide footway and a 1 metre wide verge.
