The Motor Vehicles (Driving Licences) (Amendment) Regulations 1994

The Secretary of State for Transport, in exercise of the powers conferred on him by sections 89(3)(1) and (4)(b)(2), 105(1), (3) and (4), 108(1)(3) and 192(1)(4) of the Road Traffic Act 1988(5), after consulting with representative organisations in accordance with section 195(2) of that Act, and with the approval of the Treasury, hereby makes the following Regulations:—

1.  These Regulations may be cited as the Motor Vehicles (Driving Licences) (Amendment) Regulations 1994 and shall come into force on 1st April 1994.

2.  The Motor Vehicles (Driving Licences) Regulations 1987(6) shall be amended in accordance with regulation 3 below.

3.—(1) In regulation 19(7) (Fees in respect of tests), for paragraphs (3) and (3A) there shall be substituted—

(3) Subject to paragraph (3B) below, the fee payable in respect of a test to be commenced between the hours of 0830 and 1630 on Monday to Friday (inclusive of both those days) by an examiner appointed under paragraph (1)(a) of regulation 14 is—

(a)in the case of a test for the grant of a licence authorising a person to drive a motor vehicle in category A or category P, £35; and

(b)in the case of any other test not specified in regulation 15 of the Motor Vehicles (Driving Licences) (Large Goods and Passenger-Carrying Vehicles) Regulations 1990(8), £27.50.

(3A) Subject to paragraph (3B) below, the fee payable in respect of a test to be conducted at any other time by an examiner appointed under paragraph (1)(a) of regulation 14 is—

(a)in the case of a test for the grant of a licence authorising a person to drive a motor vehicle in category A or category P, £46.50; and

(b)in the case of any other test not specified in regulation 15 of the Motor Vehicles (Driving Licences) (Large Goods and Passenger-Carrying Vehicles) Regulations 1990, £37.50.

(3B) No fee is payable in respect of a test taken in an invalid carriage..

(2) In regulation 19(5), for “£26” there shall be substituted “£27.50”.

(3) In regulation 19A(9) (Fees in respect of extended tests)—

(a)in paragraph (3)(a), for “£57” there shall be substituted “£70”; and

(b)in paragraph (3)(b), for “£48.50” there shall be substituted “£55”.

(4) In regulation 21 (Production of vehicle for test etc), for paragraph (1)(b) there shall be substituted—

(b)sign, on the Driving Test Report Form produced to him by the examiner before the test commences, a declaration that there is in force, in relation to the use of the vehicle provided for the purposes of the test, a policy of insurance which complies with the requirements of Part VI of the Road Traffic Act 1988;.

4.  Paragraphs (1), (2) and (3) of regulation 3 shall not apply in the case of an application for an appointment for a test duly made before 1st April 1994, in respect of which the fees prescribed by virtue of the Motor Vehicles (Driving Licences) (Amendment) Regulations 1993(10) apply.
