TRAFFIC REGULATION

The Motorways Traffic (Scotland) Amendment Regulations 1995

The Secretary of State, in exercise of the powers conferred on him by section 17(2) and (3) of the Road Traffic Regulation Act 1984(1), and all other powers enabling him in that behalf, and after consultation with such representative organisations as he thought fit in accordance with section 134(2) of that Act(2), hereby makes the following Regulations:

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Motorways Traffic (Scotland) Amendment Regulations 1995 and shall come into force on 1st January 1996.

(2) These Regulations shall extend to Scotland only.

Amendment of the Motorways Traffic (Scotland) Regulations 1995

2.—(1) Regulation 11 (restriction on use of right-hand lane) of the Motorways Traffic (Scotland) Regulations 1995(3) shall be amended as follows:—

(a)in paragraph (1) for sub-paragraph (b) there shall be substituted the following sub-paragraph:—

(b)a passenger vehicle which is constructed or adapted to carry more than eight seated passengers in addition to the driver, the maximum laden weight of which exceeds 7.5 tonnes;.

(2) For paragraph (5) there shall be substituted the following paragraph:—

(5) In this regulation “goods vehicle”, “passenger vehicle” and “maximum laden weight” have the same meanings as in Schedule 6 to the 1984 Act..

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Motorways Traffic (Scotland) Regulations 1995 (“the 1995 Regulations”) which regulate the use of motorways.

Regulation 11 of the 1995 Regulations prohibits certain classes of vehicle from using the right-hand lane of motorways where a carriageway has three or more lanes. Regulation 11(1)(b) is substituted so that passenger vehicles, which are constructed or adapted to carry eight or more seated persons in addition to the driver and that have a maximum laden weight that exceeds 7.5 tonnes, shall be prohibited vehicles for the purpose of that regulation.

The effect of this amendment is that it widens the range of passenger carrying vehicles prohibited from using the right hand lane of a motorway, when there are three or more lanes.
