The Export of Goods (Control) (Amendment) Order 1997

The Secretary of State, in exercise of powers conferred by section 1 of the Import, Export and Customs Powers (Defence) Act 1939(1) and now vested in him(2), hereby makes the following Order:

1.  This Order may be cited as the Export of Goods (Control) (Amendment) Order 1997 and shall come into force on 7th March 1997.

2.—(1) In article 3 of the Export of Goods (Control) Order 1994(3) there shall be inserted in paragraphs (c)(i) and (d)(i), in each case after the word “exported”, the words:

(2) At the end of paragraph (c) of the said article 3 there shall be added the following subparagraph:

(iii)any aircraft the immediately preceding importation of which was on a scheduled journey and which is intended for further scheduled journeys;.

3.  For the list of countries in Schedule 3 to the said Order of 1994 there shall be substituted the following list:

Explanatory Note

(This note is not part of the Order)

This Order removes an exemption contained in the Export of Goods (Control) Order 1994 for the export to destinations in 22 specified countries of aircraft and vessels exported after temporary import, and makes a consequential amendment in respect of scheduled journeys.

It also replaces the list in Schedule 3 to that Order (which specifies 19 of those 22 countries for the purpose mentioned above and also for the purpose of the special rules on transit in Article 3B of that Order): Afghanistan, Burundi, Tanzania and Uganda are added, Macedonia (former Yugoslav republic) and Slovenia are omitted.
