SOCIAL SECURITY

The Social Security Act 1998 (Commencement No. 3) Order 1999

22nd February 1999

The Secretary of State for Social Security, in exercise of the powers conferred by sections 79(3) and 87(2) of the Social Security Act 1998(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Social Security Act 1998 (Commencement No. 3) Order 1999.

(2) In this Order references to sections and Schedules are references to sections of and Schedules to the Social Security Act 1998.

Appointed days

2.—(1) The day appointed for the coming into force of section 51 (Class 1 contributions)–

(a)for the purpose only of authorising the making of Regulations is 23rd February 1999; and

(b)for all other purposes is 6th April 1999.

(2) The day appointed for the coming into force of the provisions specified in paragraph (3) below is 6th April 1999.

(3) The provisions specified in this paragraph are–

(a)paragraphs 16, 58(1), 59 to 61, 71(b), (c) and (e), 74, 75, 77(2) to (5), 90, 92 to 94, 99(3), 110(1)(b), 126 to 128 and 133 of Schedule 7 and section 86(1) in so far as it relates to those paragraphs;

(b)in Schedule 8 the repeals of the provisions of the Social Security Administration Act 1992(2) specified below and section 86(2) in so far as it relates to them–

(i)section 146;

(ii)in section 147(1), (2) and (3) the words “or 146”; and

(iii)in section 190, in subsection (1)(a) the word “146,”; and

(c)in Schedule 8 the repeals of the provisions specified below and section 86(2) in so far as it relates to them–

(i)the definitions of “initial primary percentage” and “main primary percentage” in section 122(1) of the Social Security Contributions and Benefits Act 1992(3); and

(ii)section 137(2) of the Pensions Act 1995(4).

Explanatory Note

(This note is not part of the Order)

This Order provides for the coming into force on 23rd February 1999 of powers under section 51 of the Social Security Act 1998 (c. 14) enabling Regulations to be made relating to national insurance contributions. For all other purposes this Order provides that section 51 shall come into force on 6th April 1999.

It further provides that section 86(1) in so far as it relates to paragraphs 16, 58(1), 59 to 61, 71(b), (c) and (e), 74, 75, 77(2) to (5), 90, 92 to 94, 99(3), 110(1)(b), 126 to 128 and 133 of Schedule 7 and section 86(2) in so far as it relates to certain repeals consequential upon the coming into force of the above provisions are to be brought into force on 6th April 1999.

All the provisions brought into force by this Order relate to national insurance contributions.

This Order does not impose a charge on business.
