The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred by section 21 of the Chronically Sick and Disabled Persons Act 1970(1), and now vested in him(2), and of all other powers enabling him in that behalf, and after consultation with the Council on Tribunals in accordance with section 21(7E) of that Act, hereby makes the following Regulations:

Citation, commencement and extent

1.  These Regulations may be cited as the Disabled Persons (Badges for Motor Vehicles) (England) (Amendment) Regulations 2000 and shall come into force on 1st July 2000.

Amendment of the Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000

2.  The Disabled Persons (Badges for Motor Vehicles (England) Regulations 2000(3) shall be amended in accordance with the following provisions of these Regulations.

Amendment of regulation 2 (interpretation)

3.  Regulation 2 shall be amended as follows—

(a)in paragraph (1) in the definition of “disabled person’s badge”, after “means” there shall be inserted “, subject to paragraph (1A),” and

(b)after paragraph (1), there shall be inserted—

(1A) For the purposes of regulations 12 to 16, the definition of “disabled person’s badge” in paragraph (1) shall include a badge issued under regulations having effect in Scotland or Wales under section 21 of the Chronically Sick and Disabled Persons Act 1970.

Amendment of regulation 4(2)(a) (descriptions of disabled persons)

4.  Regulation 4 shall be amended as follows—

In paragraph (2)(a), for “1982” there shall be substituted “1992”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000 (S.I. 2000/682) (“the 2000 Regulations”).

Regulation 3 has the effect of enabling disabled person’s badges issued under regulations made under section 21 of the Chronically Sick and Disabled Persons Act 1970 in Scotland and Wales to be displayed in England as if they were badges issued by a local authority in England.

Regulation 4 corrects the date of the Social Security and Benefits Act specified in regulation 4(2)(a) of the 2000 Regulations.

Also relevant are the Local Authorities' Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000 (S.I. 2000/683).
