The Secretary of State, in exercise of the powers conferred on her by sections 5 and 111(2) of the Electricity Act 1989M1 and after giving notice under and considering any representations in accordance with section 5(2) and (11) of that Act and after consultation with the Gas and Electricity Markets AuthorityM2 and the Scottish MinistersM3, hereby makes the following Order:—

M2The Authority was established under section 1(1) of the Utilities Act 2000.
M3S.I. 1999/1750; article 4 and Schedule 3 provide that functions under section 5(1) of the Act are, in so far as they are exerciseable in or as regards Scotland, only exercisable after consultation with the Scottish Ministers.
