The Greater London Authority (Miscellaneous Amendments) (No. 2) Order 2001

Article 2

SCHEDULEAMENDMENTS OF ENACTMENTS

The Local Government Act 1972

1.  The Local Government Act 1972(1) shall be amended in accordance with paragraphs 2 to 4.

2.  In section 223(2)(2) (appearance of local authorities in legal proceedings), after “a joint authority” there shall be inserted “, the Greater London Authority”.

3.—(1) Section 236(3) (procedure, etc., for byelaws) shall be amended as follows.

(2) In subsection (3), for “The” there shall be substituted “Subject to subsection (3A) below, the”.

(3) After subsection (3), there shall be inserted—

“(3A) Byelaws made by the Greater London Authority shall be made under the hand of the Mayor and shall not have effect until they are confirmed by the confirming authority.”.

4.  In section 238(4) (evidence of byelaws), after “purporting to be made by a local authority” there shall be inserted “, the Greater London Authority”.

The European Communities (Amendment) Act 1993

5.  In section 6 of the European Communities (Amendment) Act 1993(5) (Committee of the Regions), after “a member of the National Assembly for Wales” there shall be inserted “, the Mayor of London, a member of the London Assembly”.

The Environment Act 1995

6.—(1) Section 85 of the Environment Act 1995(6) (reserve powers of the Secretary of State or the Scottish Environment Protection Agency) shall be amended as follows.

(2) In subsection (4B) after “or (4) above” there shall be inserted “or (5A) below”.

(3) After section 85(5) there shall be inserted—

“(5A) The Mayor of London shall also have the same power to give directions to local authorities in Greater London as the Secretary of State has under subsection (5) above in relation to other local authorities.”.

The Greater London Authority Act 1999

7.  In section 385(1) of the Greater London Authority Act 1999, after “The Authority may make” there shall be inserted “and enforce”.
