The Nationality, Immigration and Asylum Act 2002 (Commencement No. 2) Order 2003

In exercise of the powers conferred upon him by section 162(1) and (6) of the Nationality, Immigration and Asylum Act 2002(1), the Secretary of State hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Nationality, Immigration and Asylum Act 2002 (Commencement No. 2) Order 2003.

(2) In this Order:

“the 1971 Act” means the Immigration Act 1971(2);

“the 1999 Act” means the Immigration and Asylum Act 1999(3); and

“the 2002 Act” means the Nationality, Immigration and Asylum Act 2002.

Commencement

2.  The provisions of the 2002 Act specified in column 1 of the Schedule to this Order shall come into force on the date specified in column 2 of that Schedule, but where a particular purpose is specified in relation to any such provision in column 3 of that Schedule, the provision concerned shall come into force on that date only for that purpose.

Explanatory Note

This Order brings section 18 of the Nationality, Immigration and Asylum Act 2002 into force for certain purposes on 8th January 2003 and on 10th February 2003, and brings certain other provisions of that Act which are set out in the Schedule to the Order into force on 10th February 2003.

Section 55 of the Nationality, Immigration and Asylum Act 2002 (c. 41) (late claims for asylum: refusal of support) is commenced on 8th January 2003 by the Nationality, Immigration and Asylum Act 2002 (Commencement No. 1) Order 2002 (S.I. 2002/2811). That Order commenced certain paragraphs of Schedule 3 to that Act (withholding and withdrawal of support) on 8th December 2002 for the purpose of enabling the Secretary of State to exercise the power to make subordinate legislation, and commences Schedule 3, so far as not already in force, on 8th January 2003. Pursuant to section 162 of that Act, section 70 (induction) came into force on Royal Assent, on 7th November 2002.

Section 26A of the Immigration Act 1971 (c. 77) (registration card) is inserted by section 148 of the Nationality, Immigration and Asylum Act 2002, which is commenced by this Order.
