3.—(1) The regulations shall be amended as follows.
(2) For regulation 4 there shall be substituted the following regulation:–
“4. The capacity of a school is to be determined in accordance with the method of assessment provided in the Department for Education and Skills Guidance “Assessing the Net Capacity of Schools” (reference number DfES/0739/2001 REV) issued in August 2002 (ISBN 1 84185 610 X)”
(3) Schedule 2 to the regulations is hereby revoked.
