In exercise of the powers conferred upon the Secretary of State by sections 518 and 569(4) of the Education Act 1996(1), the Secretary of State for Education and Skills hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Education Maintenance Allowance (Pilot Areas) (Revocation) Regulations 2004 and shall come into force on 1st May 2004.

Revocation and savings

2.—(1) Subject to paragraphs (2) and (3) the following regulations are revoked —

(a)the Education Maintenance Allowance (Pilot Areas) Regulations 2001(2);

(b)the Education Maintenance Allowance (Pilot Areas) (Amendment) Regulations 2002(3); and

(c)the Education Maintenance Allowance (Pilot Areas) (Amendment) Regulations 2003(4).

(2) The regulations referred to in paragraph (1) shall continue to have effect until the end of 31st August 2004 in relation to students who—

(a)are receiving for the academic year 2003 – 2004 any of the allowances specified in regulation 8, 9, 10 or 11 of the Education Maintenance Allowance (Pilot Areas) Regulations 2001, or

(b)applied for any such allowance for the academic year 2003 – 2004 before 1st May 2004, or

(c)apply for any such allowance for the academic year 2003 – 2004 on or after 1st May 2004.

(3) In paragraph (2) “academic year” has the same meaning as in the Education Maintenance Allowance (Pilot Areas) Regulations 2001.

Explanatory Note

(This note is not part of the Regulations)

These Regulations revoke the Education Maintenance Allowance (Pilot Areas) Regulations 2001 (S.I. 2001/2750), the Education Maintenance Allowance (Pilot Areas) (Amendment) Regulations 2002 (S.I. 2002/1841) and the Education Maintenance Allowance (Pilot Areas) (Amendment) Regulations 2003 (S.I. 2003/553). However, they remain in force until 31st August 2004 in relation to those students who have applied for, or are already in receipt of, an Education Maintenance Allowance (EMA) for the academic year 2003 – 2004 at the date when the Regulations come into force, being 1st May 2004, and in relation to those students who apply for an EMA for that academic year after the Regulations have come into force.
