The Treasury, in exercise of the powers conferred upon them by section 13 of the National Insurance Contributions and Statutory Payments Act 2004(1) make the following Order:
1.—(1) This Order may be cited as the National Insurance Contributions and Statutory Payments Act 2004 (Commencement) Order 2004.
(2) In this Order “the 2004 Act” means the National Insurance Contributions and Statutory Payments Act 2004.
2. The following provisions of the 2004 Act shall come into force on 1st September 2004—
(a)section 1 (payment of Class 1 contributions: Great Britain);
(b)section 2 (payment of Class 1 contributions: Northern Ireland);
(c)section 3 (agreements and joint elections: Great Britain);
(d)section 4 (agreements and joint elections: Northern Ireland);
(e)section 5 (recovery of contributions, etc: Great Britain);
(f)section 6 (recovery of contributions, etc: Northern Ireland).
3. The following provisions of the 2004 Act shall come into force on 1st January 2005—
(a)section 9(1), (2) and (3) (compliance regime for statutory sick pay and statutory maternity pay: Great Britain);
(b)section 10(1), (2) and (3) (compliance regime for statutory sick pay and statutory maternity pay: Northern Ireland).
4. The following provisions of the 2004 Act shall come into force on 6th April 2005—
(a)section 7 (Class 1, 1A, 1B or 2 contributions: powers to call for documents, etc: Great Britain);
(b)section 8 (Class 1, 1A, 1B or 2 contributions: powers to call for documents, etc: Northern Ireland);
(c)section 9(4) and (5); and
(d)section 10(4) and (5).
5. Section 11 of, and Schedule 1 to, the 2004 Act (minor and consequential amendments) shall come into force —
(a)for the purpose of the following provisions of that Schedule—
(i)paragraph 1;
(ii)paragraph 2;
(iii)in paragraph 3, sub-paragraph (3) and sub-paragraph (1) so far as relating to that sub-paragraph;
(iv)in paragraph 4 sub-paragraph (3) and sub-paragraph (1) so far as relating to that sub-paragraph;
(v)paragraph 5;
on 1st September 2004;
(b)for the purposes of the following provisions of that Schedule—
(i)in paragraph 3, sub-paragraph (2) and sub-paragraph (1) so far as relating to that sub-paragraph;
(ii)in paragraph 4, sub-paragraph (2) and sub-paragraph (1) so far as relating to that sub-paragraph;
on 6th April 2005.
6. Section 12 of, and Schedule 2 to, the 2004 Act (repeals) shall come into force—
(a)so far as they relate to the repeal of provisions of—
(i)the Social Security Contributions and Benefits Act 1992(2);
(ii)the Social Security Contributions and Benefits (Northern Ireland) Act 1992(3);
(iii)the Social Security Contributions (Transfer of Functions, etc.) Act 1999(4), except the provisions of Schedule 5 to that Act;
(iv)the Welfare Reform and Pensions Act 1999(5);
on 1st September 2004;
(b)so far as they relate to the repeal of provisions of—
(i)the Taxes Management Act 1970(6);
(ii)the Social Security Administration Act 1992(7);
(iii)the Social Security Administration (Northern Ireland) Act 1992(8);
(iv)Schedule 5 to the Social Security Contributions (Transfer of Functions, etc.) Act 1999;
(v)the Child Support Pensions and Social Security Act 2000(9);
(vi)the Child Support, Pensions and Social Security Act (Northern Ireland)2000(10);
on 6thApril 2005;
(c)so far as they relate to the revocation of provisions of—
(i)the Social Security (Northern Ireland) Order 1998(11);
(ii)Schedule 3 and paragraph 8 of Schedule 4 to the Social Security Contributions (Transfer of Functions, etc.) (Northern Ireland) Order 1999(12);
on 1st September 2004;
(d)so far as they relate to the revocation of provisions of paragraphs 1 and 3 of Schedule 4 to the Social Security Contributions (Transfer of Functions, etc.) (Northern Ireland) Order 1999, on 6th April 2005.
