52.—(1) Where the claimant is in receipt of any benefit under Parts 2, 3 or 5 of the Act or pension under the Naval, Military and Air Forces etc. (Disablement and Death) Service Pensions Order 1983(1), any increase in the rate of that benefit arising under Part 4 (increases for dependants) or section 106(a) (unemployability supplement) of the Act or the rate of that pension under that Order where the dependant in respect of whom the increase is paid is not a member of the claimant’s family.
(2) For the purposes of sub-paragraph (1), an addition to a contribution-based jobseeker’s allowance under regulation 10(4) of the Jobseeker’s Allowance (Transitional Provisions) Regulations 1996(2) shall be treated as an increase of a benefit under the Act arising under Part 4 of the Act.
