5.— [F1(1)] Where a producer is a member of a registered scheme throughout a relevant year he is exempt from complying with his producer responsibility obligations for the relevant year.

[F2(2) A producer shall not be a member of a registered scheme for the purposes of these Regulations if they fail to—

(a)provide any information the scheme requests for the purposes of meeting its producer responsibility obligations within a reasonable period of receiving such a request; or

(b)pay any fee required for membership of the scheme.]
