This Order is made in exercise of the powers conferred by paragraphs 8(1) of Schedule 8 and 3(1) of Schedule 10 to the Traffic Management Act 2004(1).
Cheshire County Council has applied to the Secretary of State for an order to be made under these powers in respect of part of its area.
The Secretary of State has consulted the Chief Constable of the Cheshire Constabulary in accordance with the requirements of paragraphs 8(3) of Schedule 8 and 3(4) of Schedule 10.
Accordingly, the Secretary of State for Transport(2) makes this Order.
1. This Order may be cited as the Civil Enforcement of Parking Contraventions (County of Cheshire) (City of Chester and Borough of Ellesmere Port & Neston) Designation Order 2008 and shall come into force on 8th January 2009.
2. The Secretary of State designates the area described in the Schedule as—
(a)a civil enforcement area for parking contraventions; and
(b)a special enforcement area.

Article 2
This Order applies to the area of the City of Chester and the area of the Borough of Ellesmere Port & Neston with the exception of—
(a)the M53 and M56 (including their slip roads) within these areas;
(b)the A550—
(i)within the area of the City of Chester from the boundary of the Borough of Ellesmere Port & Neston (at Ordnance Survey National Grid reference point SJ354758) to the boundary of the County of Cheshire with the County of Flintshire (at Ordnance Survey National Grid reference point SJ339711), and
(ii)within the area of the Borough of Ellesmere Port & Neston from its junction with the A41 to the boundary of the City of Chester (at Ordnance Survey National Grid reference point SJ354758);
(c)the A5117 within the area of the City of Chester from—
(i)its westerly junction with the M56 including the roundabout at that junction to its junction with the A540, and
(ii)the point where it crosses under junction 10 of the M53 to the point where it goes over junction 14 of the M56 including in both cases the roundabout at those junctions;
(d)the A55 (including the slip roads) within the area of the City of Chester from its commencement at junction 12 of the M53 to the boundary of the County of Cheshire with the County of Flintshire (at Ordnance Survey National Grid reference point SJ357632);
(e)the A483 within the area of the City of Chester from its junction with the A55 including the roundabout at that junction to the boundary of the County of Cheshire with the County Borough of Wrexham (at Ordnance Survey National Grid reference point SJ366594);
(f)the A41 within the area of the City of Chester from its junction with the A56 to the boundary of the County of Cheshire with the County of Shropshire (at Ordnance Survey National Grid reference point SJ521433);
(g)the A54 within the area of the City of Chester from its junction with the A51 to the boundary of the Vale Royal Borough (at Ordnance Survey National Grid reference point SJ531689);
(h)the A49 within the area of the City of Chester from the boundary of—
(i)the Vale Royal Borough at Tarporley (at Ordnance Survey National Grid reference point SJ555616) to the boundary of the Crewe & Nantwich Borough at Bunbury (at Ordnance Survey National Grid reference point SJ558586), and
(ii)the Crewe & Nantwich Borough at Cholmondeley (at Ordnance Survey National Grid reference point SJ548497) to the boundary of the Crewe & Nantwich Borough at the Shropshire Union Canal (at Ordnance Survey National Grid reference point SJ 539464);
(i)the A540—
(i)within the area of the Borough of Ellesmere Port & Neston from the boundary of the City of Chester (at Ordnance Survey National Grid reference point SJ336755) to its junction with the B5133, and
(ii)within the area of the City of Chester from its boundary with the Borough of Ellesmere Port & Neston (at Ordnance Survey National Grid reference point SJ336755) to its junction with the A550; and
(j)the A494 (including the slip roads) within the City of Chester from its commencement at the end of the M56 to the boundary of the County of Cheshire with the County of Flintshire (at Ordnance Survey National Grid reference point SJ339711).

This Order designates the area described in the Schedule as a civil enforcement area and a special enforcement area for parking contraventions for the purposes of Part 6 of the Traffic Management Act 2004.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
The Secretary of State is the “appropriate national authority” for England for the purposes of Part 6 of the Traffic Management Act 2004 under section 92 of that Act.
