The Secretary of State is designated(1) for the purpose of making Regulations under section 2(2) of the European Communities Act 1972(2) (“the Act”) in relation to the environment.
In accordance with section 56(1) of the Finance Act 1973(3), the Treasury consents to the making of these Regulations.
The Secretary of State makes these Regulations in exercise of the powers conferred by section 2(2) of the Act and section 56 of the Finance Act 1973.
S.I. 2008/301. As regards functions transferred to the Scottish Ministers by the Scotland Act 1998 (c. 46), these Regulations extend to Scotland by virtue of section 57(1) of that Act.
