Her Majesty, in exercise of the powers conferred by sections 4(2) and 5(9) of the Parliamentary Commissioner Act 1967(1), is pleased, by and with the advice of Her Privy Council, to make the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Parliamentary Commissioner Order 2011 and comes into force on 30th April 2011.

(2) In this Order “the Act” means the Parliamentary Commissioner Act 1967.

Amendment to Schedule 2 to the Act

2.  For Schedule 2 to the Act (Departments etc. subject to investigation), substitute the Schedule set out in the Schedule to this Order.

Amendment to Schedule 4 to the Act

3.  In Schedule 4 to the Act (Relevant tribunals for the purposes of section 5(7))—

(a)omit “Persons hearing consumer credit licensing appeals appointed under regulation 24 of the Consumer Credit Licensing (Appeals) Regulations 1998.”(2);

(b)for “Valuation tribunals continued in existence under regulation 3 of the Valuation and Community Charge Tribunals Regulations 1989”(3) substitute “The Valuation Tribunal for England established under Schedule 11 to the Local Government Finance Act 1988”(4).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Parliamentary Commissioner Act 1967 (“the Act”). Article 2 of this Order substitutes the Schedule to this Order for Schedule 2 to the Act (Departments etc. subject to investigation). The change of name from the “Rail Passengers’ Council” to the “Passengers’ Council” is to correct a change of name inadvertently made by the Parliamentary Commissioner Order 2010 (S.I. 2010/239) reversing the change made by the Passengers’ Council (Non-Railway Functions) Order 2010 (S.I. 2010/439). The addition of the Supreme Court is subject to a note, which provides that the entry only applies in respect of action taken by administrative staff but not so far as that action is taken at the direction, or on the authority, of any person acting in a judicial capacity. The following table shows the changes that have been made to Schedule 2 by this Order.

This Order also amends the entries in Schedule 4 referred to in article 3 of this Order.

A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
