The Queen’s Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred on Her by section 112 of the Saint Helena Act 1833(1), the British Settlements Acts 1887 and 1945(2), and all of the other powers enabling Her to do so, is pleased, by and with the advice of Her Privy Council, to order as follows:

Citation, commencement, interpretation and extent

1.—(1) This Order may be cited as the Zimbabwe (Sanctions) (Overseas Territories) (Suspension and Amendment) Order 2013.

(2) It comes into force on 11th July 2013.

(3) In this Order, “the principal Order” means the Zimbabwe (Sanctions) (Overseas Territories) Order 2012(3).

(4) This Order extends to the territories listed in Schedule 1 to the principal Order.

Amendment of the principal Order

2.—(1) The principal Order is amended as follows.

(2) In article 4(7), delete “and 10” and substitute “, 10 and 11”.

(3) For article 7(1), substitute—

7.(1) It is an offence for a person to knowingly sell, supply, transfer or export (directly or indirectly) restricted goods—

(a)to any person in Zimbabwe, or

(b)for use in Zimbabwe.

(4) In article 7(8), delete “article 10” and substitute “articles 10 and 11”.

(5) In article 8(3), delete “article 10” and substitute “articles 10 and 11”.

(6) In article 9(2), delete “article 10” and substitute “articles 10 and 11”.

(7) In Schedule 2—

(a)in paragraph 3(1), delete “article 7(3)” and substitute “article 7(2)”;

(b)in paragraph 5, in the definition of “relevant person”, delete “article 7(5) and (6)” and substitute “article 7(4) and (5)”.

(8) In paragraph 1 of Schedule 5, delete “articles” and substitute “article”.

Suspension of financial sanctions in the principal Order

3.  Articles 4, 5, and 6 of the principal Order are to have no effect from the date on which this Order comes into force in so far as those articles apply to persons and entities listed in the Annex to Council Regulation (EU) 298/2013 adopted by the Council of the European Union on 27th March 2013(4).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order suspends financial sanctions provisions of the Zimbabwe (Sanctions) (Overseas Territories) Order 2012 which gave effect in certain overseas territories to sanctions against Zimbabwe adopted by the Council of the European Union.

On 27th March 2013, by Council Decision 2013/160/CFSP, in view of positive political developments in Zimbabwe, the Council of the European Union decided to suspend, in relation to the majority of designated persons and entities, the application of all financial sanctions. The Council of the European Union will review the suspension every three months.

This Order also makes minor corrections to the principal Order.
