The A168 Trunk Road (Blakey Lane) (Detrunking) (No.2) Order 2013

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980(1) and now vested in him(2):—

1.  This Order may be cited as A168 Trunk Road (Blakey Lane) (Detrunking) (No.2) Order 2013 and shall come into force on 1 March 2013.

2.  In this Order—

(1) “the plan” means the plan numbered HA 10/NDD/002, marked “The A168 Trunk Road (Blakey Lane) (Detrunking) (No.2) Order 2013”, signed by authority of the Secretary of State for Transport and deposited at Communities and Local Government, Deposited Document Services, Room F13, Ashdown House, St Leonards on Sea, Hastings, East Sussex, TN37 7GA;

(2) “classified road” as a classification for a highway, means that the highway is not a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads; and

(3) “the trunk road” means the A168 Trunk Road in the District of Hambleton in the County of North Yorkshire.

3.  The length of the trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a classified road as from the date on which the Secretary of State notifies the North Yorkshire County Council (who will become the highway authority responsible for these lengths), that the Order has come into force.

SCHEDULELENGTH OF THE TRUNK ROAD CEASING TO BE TRUNK ROAD

The length of the trunk road ceasing to be a trunk road, located at the junction of, and connecting to, Blakey Lane (near Thirsk Farmers Auction Mart) is shown by heavy black hatching on the plan.

EXPLANATORY NOTE

(This note is not part of the Order)

The purpose of the Order is to authorise the Secretary of State to remove the trunk road status from the lengths of trunk road described in the above schedule. The responsibility for the maintenance of these lengths of road will thereafter pass to the local Highway Authority, which is North Yorkshire County Council.

This Order completes the previous detrunking of an adjoining length of this road that was the subject of an earlier made detrunking order completed in 2006. This is to facilitate the provision of an improved access onto Blakey Lane in connection with the existing Thirsk Auction Mart Development.
