The Secretary of State is designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy.
The Secretary of State has carried out consultation in accordance with section 16(1) of the Plant Varieties and Seeds Act 1964(3).
The Secretary of State makes the following Regulations in exercise of the powers in section 16(1) and (1A) of the Plant Varieties and Seeds Act 1964 and section 2(2) of the European Communities Act 1972.
S.I. 1972/1811. The power of the Secretary of State, as designated Minister, to make Regulations that (i) extend to Scotland remains exercisable by virtue of section 57(1) of the Scotland Act 1998 (c.46); (ii) extend to Northern Ireland remains exercisable by virtue of article 3(2) of the European Communities (Designation) (No. 3) Order 2000 (S.I. 2000/2812); and (iii) apply in Wales remains exercisable by virtue of article 6(1) of the European Communities (Designation) (No. 5) Order 2010 (S.I. 2010/2690).
1972 c. 68. Section 2(2) was amended by the Legislative and Regulatory Reform Act 2006 (c.51), section 27(1)(a), and the European Union (Amendment) Act 2008 (c.7), Part 1 of the Schedule.
1964 c. 14. Section 16(1) and (1A) has been amended by the European Communities Act 1972 (c. 68), section 4 and Schedule 4, paragraph 5. See section 38(1) for the definition of “the Minister”. Under S.I. 2002/794, the functions of the Minister of Agriculture, Fisheries and Food under the Plant Varieties and Seeds Act 1964 which remained vested in that Minister were transferred to the Secretary of State.
