The Secretary of State makes these Regulations in exercise of the powers conferred by sections 49B(3) and 89(4) of the Further and Higher Education Act 1992(1).
1992 c. 13. Section 49B was inserted by section 80 of the Small Business, Enterprise and Employment Act 2015 (c. 26). Section 89(4) was amended by section 29 of, and paragraphs 6 and 11 of Schedule 1 to, the Further Education and Training Act 2007 (c. 25). For the definitions of ‘prescribed’ and ‘regulations’ see section 579(1) of the Education Act 1996 (c. 56).
