Restricting, suspending or withdrawing [F1United Kingdom] conformity approvalU.K.
23.—(1) [F2An approved] body may by giving notice to the manufacturer restrict, suspend or withdraw EU conformity approval of equipment or a quality system where a manufacturer fails—
(a)to take corrective measures required under regulation 12(5); or
(b)to comply with regulation 16 or 20(1) to (6).
(2) Before issuing a notice under paragraph (1), [F3an approved] body must give the manufacturer an opportunity to make written representations.
(3) A notice under paragraph (1) must—
(a)be in writing;
(b)specify the date on which it is to take effect; and
(c)specify the grounds for the decision.
(4) [F4The approved] body must send a copy of any notice given under paragraph (1) to the Secretary of State.
