The Energy Act 2016 (Commencement No. 1 and Savings Provisions) (Amendment) Regulations 2016

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Energy Act 2016 (Commencement No. 1 and Savings Provisions) Regulations 2016 (S.I. 2016/602 (C. 43)) (the “Commencement Regulations”) by substituting regulation 3. As substituted, regulation 3 omits paragraph (h) of the Commencement Regulations, which provided for the commencement of section 83 of the Energy Act 2016 (c. 20) (the “2016 Act”) on 12th July 2016. Section 83 of the 2016 Act disapplies the obligation of the Secretary of State to consult the Oil and Gas Authority before exercising a power to make regulations in respect of the first exercise of each power within one year of section 1 of the 2016 Act coming into force. However, section 83 was already brought into force by section 84(1) of that Act with effect from 12th May 2016. The new regulation 3 therefore omits regulation 3(h) of the Commencement Regulations for clarity.
