The Secretary of State makes these Regulations in exercise of the powers conferred by section 8(1) to the European Union (Withdrawal) Act 2018(1).

The requirements of paragraph 3(2) of Schedule 7 to that Act (relating to the appropriate Parliamentary procedure for these Regulations) have been satisfied.

Citation and commencement

1.—(1) These Regulations may be cited as the Electricity Network Codes and Guidelines (System Operation and Connection) (Amendment etc.) (EU Exit) (No. 2) Regulations 2019.

(2) These Regulations come into force on the day before that on which exit day falls.

Revocation of regulation 5 of the Electricity Network Codes and Guidelines (System Operation and Connection) (Amendment etc.) (EU Exit) Regulations 2019

2.  Regulation 5 of the Electricity Network Codes and Guidelines (System Operation and Connection) (Amendment etc.) (EU Exit) Regulations 2019(2) is revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations are made in exercise of the powers in section 8(1) of the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively arising from the withdrawal of the United Kingdom from the European Union.

These Regulations revoke regulation 5 of the Electricity Network Codes and Guidelines (System Operation and Connection) (Amendment etc.) (EU Exit) Regulations (S.I. 2019/533). As a result, Commission Regulation (EU) No 2016/631 establishing a network code on requirements for grid connection of generators, Commission Regulation (EU) No 2016/1388 establishing a network code on demand connection and Commission Regulation (EU) No 2016/1447 establishing a network code on requirements for grid connection of high voltage direct current systems and direct current-connected power park modules will form part of the domestic law of the United Kingdom on and after exit day by virtue of section 3 of the European Union (Withdrawal) Act 2018.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen.
