SCHEDULE 5 E+W Modifications of police and crime commissioner enactments in their application to the Mayor

PART 1 E+W Primary legislation

28.  For section 63(1) and (2), substitute— E+W

“(1) Subsection (2) applies where—

(a) the deputy mayor is appointed under section 107C of the 2009 Act to act for the Mayor because the Mayor is unable to act; and

(b) the Mayor does not cease to be unable to act during the period of 6 months beginning with the day on which the acting Mayor was appointed.

(2) At the end of that 6 month period—

(a) the Mayor ceases to be the Mayor, and

(b) accordingly, the office of Mayor becomes vacant.”.
