The Secretary of State makes the following Regulations in exercise of the powers conferred by section 17(2) and (3) of the Road Traffic Regulation Act 1984(1).
Representative organisations have been consulted in accordance with section 134(2) of that Act.
1. These Regulations may be cited as the M6 Motorway (Junction 19) (40 Miles Per Hour Speed Limit) Regulations 2021 and come into force on 2nd August 2021.
2. In these Regulations—
“the M6” means the motorway known by that name;
“the Tabley Interchange” means the circular intersection at junction 19 of the M6;
“back”, in relation to a nose, means the shortest side of a nose;
“carriageway” and “motorway” have the same meaning as in the Motorways Traffic (England and Wales) Regulations 1982(2);
“diverge nose” means a nose between the main carriageway of a motorway and an off-slip road;
“nose” means a paved piece of land approximately triangular in shape which is marked with road markings of a type shown in diagram 1042 in Part 6 of Schedule 9 to the Traffic Signs Regulations and General Directions 2016(3); and
“off-slip road” means a road at junction 19 of the M6 intended for the use of traffic exiting the M6.
3. No person shall drive a vehicle at a speed exceeding 40 miles per hour on–
(a)the off-slip road on the northbound carriageway beginning at a point which is 89 metres from the back of the diverge nose and ending at the points where the nearside and offside lanes merge with the Tabley Interchange; or
(b)the off-slip road on the southbound carriageway beginning at a point which is 88 metres from the back of the diverge nose and ending at the points where the nearside and offside lanes merge with the Tabley Interchange.
4.—(1) The Schedule (the Specified Roads) to the M6 Motorway (Junctions 16 to 19) (Variable Speed Limits) Regulations 2018(4) is amended in accordance with this regulation.
(2) In paragraph 3 in the appropriate places insert–
““back”, in relation to a nose, means the shortest side of a nose;”;
““diverge nose” means a nose between the main carriageway of a motorway and an off-slip road;”; and
““nose” means a paved piece of land approximately triangular in shape which is marked with road markings of a type shown in diagram 1042 in Part 6 of Schedule 9 to the 2016 Regulations and Directions;”.
(3) In paragraph 4 for sub-paragraph (f) substitute–
“(f)at junction 19–
(i)the on-slip roads connecting from the A556;
(ii)that length of the off-slip road connecting from the northbound carriageway to the A556 beginning at the diverge from the northbound carriageway and ending at a point which is 89 metres from the back of the diverge nose; and
(iii)that length of the off-slip road connecting from the southbound carriageway to the A556 beginning at the diverge from the southbound carriageway and ending at a point which is 88 metres from the back of the diverge nose.”.

These Regulations replace variable speed limits on the M6 motorway at junction 19 with a fixed speed limit of 40mph. The lengths of the northbound and southbound off-slip roads are subject to the 40 mph speed limit on their approach to the Tabley Interchange.
Contravention of these Regulations is an offence under section 17(4) of the Road Traffic Regulation Act 1984.
An impact assessment has not been prepared for these Regulations as no significant impact on the cost of business or the voluntary sector is foreseen. An Explanatory Memorandum is published alongside the Regulations at www.legislation.gov.uk.
1984 c.27; section 17(2) was amended by the New Roads and Street Works Act 1991 (c.22), Schedule 8, Part 2, paragraph 28(3); section 17(2)(b) was amended by the Road Traffic Act 1991 (c.40), Schedule 8; section 17(2)(d) was inserted by the Road Traffic Act 1991 (c.40), Schedule 4, paragraph 25. There are other amendments to sections 17 and 134 which are not relevant to these Regulations.
