The Lord Chancellor, in exercise of the powers conferred by section 51(4) and (5) of the Judicial Review and Courts Act 2022(1), makes the following Regulations:

Citation and interpretation

1.—(1) These Regulations may be cited as the Judicial Review and Courts Act 2022 (Commencement No. 2) Regulations 2022.

(2) In these Regulations, “the Act” means the Judicial Review and Courts Act 2022.

Provision coming into force

2.  Section 5 of the Act (extension of single justice procedure to corporations) comes into force on the 21st day after the day on which these Regulations are made.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations bring into force section 5 of the Judicial Review and Courts Act 2022 (c. 35). Section 5 amends section 16A of the Magistrates’ Courts Act 1980 (c. 43) to widen the scope of the single justice procedure to include prosecution of legal persons such as corporations. An impact assessment has not been produced for this instrument as no significant impact on the private, voluntary or public sectors is foreseen.
