The Armed Forces Act 2021 (Commencement No. 7) Regulations 2023

The Secretary of State makes these Regulations in exercise of the power conferred by section 24(1) of the Armed Forces Act 2021(1).

Citation, interpretation and extent

1.—(1) These Regulations may be cited as the Armed Forces Act 2021 (Commencement No. 7) Regulations 2023.

(2) In these Regulations, “the Act” means the Armed Forces Act 2021.

(3) These Regulations extend to England and Wales, Scotland, Northern Ireland, the Isle of Man and the British overseas territories (except Gibraltar).

Commencement of sections 4 to 7 of the Act

2.  Sections 4 (summary hearings: power to rectify mistakes etc), 5 (the Summary Appeal Court: power to rectify mistakes), 6 (the Service Civilian Court: power to rectify mistakes) and 7 (concurrent jurisdiction) of the Act come into force on 13th November 2023, in so far as they are not already in force.

Commencement of section 14 (deprivation orders) of the Act

3.  Section 14 (deprivation orders) of the Act comes into force on 22nd November 2023, in so far as it is not already in force.

Commencement of section 17 (removal of requirement to take into account offences in member states) of the Act

4.  Section 17 (removal of requirement to take into account offences in member states) of the Act comes into force on 13th November 2023.

Explanatory Note

(This note is not part of the Regulations)

These Regulations bring into force sections 4 to 7 of the Armed Forces Act 2021 (c. 35) (“the Act”) on 13th November 2023, to the extent that those provisions were not already in force.  They also bring into force section 17 of the Act on the same day. Section 14 is brought into force on 22nd November 2023, to the extent that it was not already in force.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
