The Secretary of State makes these Regulations in exercise of the powers conferred by section 2(5)(a), (7) and (9)(b) of the Glue Traps (Offences) Act 2022(1).

Citation, commencement, extent and interpretation

1.—(1) These Regulations may be cited as the Glue Traps (Licensing) Regulations 2024 and come into force on 19th June 2024.

(2) These Regulations extend to England and Wales.

(3) In these Regulations—

the Act” means the Glue Traps (Offences) Act 2022;

Natural England” means the body established by section 1 of the Natural Environment and Rural Communities Act 2006(2).

Delegation of functions

2.—(1) The Secretary of State delegates the functions in section 2(1), (2), (3) and (4) of the Act (glue trap licences) to Natural England.

(2) The Secretary of State authorises Natural England to charge fees in relation to an application for the grant or modification of a glue trap licence(3) in accordance with section 2(5)(a) of the Act.

Licence charges

3.—(1) The applicant for a glue trap licence of a description in column 1 of the Schedule must pay to Natural England in respect of each application of the type described in column 2 of the Schedule—

(a)the fixed charge specified in the corresponding entry in column 3 of the Schedule; and

(b)an additional charge for the number of hours reasonably spent by Natural England in—

(i)assessing the glue trap licence application and where applicable requesting further information from the applicant;

(ii)where applicable, assessing an application for modification of the glue trap licence and requesting further information from the applicant.

(2) An additional charge referred to in paragraph (1)(b) is calculated by multiplying the total number of hours reasonably spent by Natural England working on a glue trap licence application or application to modify a glue trap licence by £121.

(3) For the purposes of paragraph (2), the number of hours spent may be rounded to the nearest quarter of an hour, where the time spent is less than one hour or not a whole number of hours.

(4) A charge payable under this regulation is payable to Natural England on demand.

(5) Natural England may, if it sees fit, reduce or remit any charge payable under this regulation.

Explanatory Note

(This note is not part of the Regulations)

These Regulations make provision about glue trap licensing in England. They delegate glue trap licensing functions conferred on the Secretary of State under the Glue Traps (Offences) Act 2022 (c.26) (“the Act”) to Natural England and provide for charges in respect of glue trap licence applications.

Regulation 2(1) delegates the Secretary of State’s licensing functions under section 2(1) to (4) of the Act to Natural England. Regulation 2(2) authorises Natural England to charge fees related to its licensing functions.

Regulation 3 provides for charges associated with assessing applications for a glue trap licence or the modification of a glue trap licence and requesting further information from the applicant. These consist of a fixed charge, set out in Column 3 of the Schedule to the Regulations and an additional charge of £121 per hour to be calculated according to the number of hours reasonably spent by Natural England in assessing an application for a glue trap licence or modification of a glue trap licence and requesting further information from the applicant. Regulation 3 also enables Natural England to reduce or remit any charge payable under these Regulations.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
